Terms & Conditions.
Hereinafter the service provider shall mean RecoilTwisters Trampoline Club and the service user shall mean the customer or the parents/guardian of the customer if aged under 18yrs i.e. after membership of British Gymnastics/RecoilTwisters membership fee and course payment fees have been made by the customer.
All contracts are accepted subject to the following terms and conditions, which shall not be varied, accept as agreed by the service provider in writing.
Performance of Contract
The performance of the contract shall be made to the place, at the time and date(s) specified on acceptance of the invoice, accept as agreed by the service provider in writing. The service provider shall make every reasonable endeavour to maintain any stated delivery date(s) and time but accepts no liability whatsoever for the consequences of delay.
The postponement of the performance of the contract by the service user, once agreed by the service user, shall render the service user liable to pay the service provider all costs caused by the service users refusal of the performance of the contract on the due date at the specified time and place.
The postponement of the performance of the contract by the service provider once agreed with the service user, shall render the service provider liable to provide an alternative solution to the service user that is acceptable to both parties.
On the grounds of Health & Safety the service provider reserves the right to refuse service delivery if the service provider believes that it is not in the best interest of the service user or service provider to continue.
Payment – course fees
Payment shall be made in accordance with the invoice or other documents issued by the service provider to the service user. The service user must pay the service provider without right of set-off or deduction and unless specified on the invoice by commencement of the new term. In any case payment must be received prior to the commencement of the service. If payment is not received the service provider will charge a £10 late payment penalty fee.
Payment – membership fees
It is a requirement of British Gymnastics (BG) the Governing Body of Trampolining, that all participants are registered with them. The service user must complete the Club Registration Form and return it with payment before the service can be delivered. The
service provider will register its members with BG on behalf of the service user.
The service provider shall in accordance with the invoice or other documents issue notice of fees to the service user and such fees shall be inclusive and are not subject to Value Added Tax.
Any recommendation or advice relating to goods or services provided contained in literature issued by the service provider is for guidance only without liability on the part of the service provider. The service user must satisfy himself as to the suitability of the product or services for his/her own particular purpose.
Cancellation and Suspension of Service Delivery
Should the service user be in breach of any facility or Club rules or if the service user becomes subject to the laws relating to insolvent debtors or if the service user commits any act of bankruptcy or goes into liquidation or if a receiver is appointed for any of the service users assets, then the service provider shall be entitled to withhold further service delivery until receipt of payment in advance thereof and may, at his option, and without prejudice to his other rights and remedies, cancel all undelivered services ordered by the service user.
The service provider does not have a cash refund policy. Therefore, in the event of the service provider cancelling a session the service user will be offered either an alternative session or a credit note.
The service provider reserves the right to defer the date of delivery or cancel the contract between service user and service provider arising from these terms and conditions if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of the service provider including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riots, civil commotion, fire, lock-outs, strikes or other labour disputes Provided that, if the event in question continues for a continuous period of 30 days, the service user shall be entitled to give notice in writing to the service provider to terminate the contract between service users and service provider arising from these terms and conditions.
a) the service provider shall not be liable to the service user for any indirect or consequential loss or damage, costs, expenses or other claims for compensation whatsoever arising out of or in connection with the contract between the service provider and the service user arising from these terms and conditions.
English Law shall govern the contract.
